| Nanjing Intermediate People's Court Held that JNG China did not Constitute Unfair Competition and Dismissed All Claims of Jiangsu Cohen Environmental Protection Co., Ltd. |
On December 22, 2020, JNG China received the civil judgment of Nanjing Intermediate People's Court in Jiangsu Province ((2019) Su, 01, Civil, First Instance, Document Number 3365). The judgement held that the letter of complaint sent by Jiangnan Environmental Protection Company in the bidding process, as well as the announcement in the lawsuit, were neither disinformation nor misinformation, but were acts of right remedy in accordance with the law for the legitimate purpose of safeguarding its own intellectual property rights, neither improper nor illegal, so they did not constitute business slander. The judgement held that the claims of the plaintiff, Jiangsu Cohen Environmental Protection Co., Ltd., were dismissed, and that the case acceptance fee of 195,550 yuan should be borne by the plaintiff.
